Terms of Service — ByDukaan

1. Agreement to Terms

By purchasing, downloading, activating, or accessing software, website templates, or digital services from ByDukaan (accessible via https://bydukaan.com/), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not purchase or use our products.

2. Digital Software Grant of License

All software products sold on ByDukaan are licensed, not sold. Subject to timely payment of applicable fees, ByDukaan grants you a non-exclusive, non-transferable, revocable license to install and run the software according to the purchase tier:

Single-Terminal / Single-Store License: Permits activation on exactly one (1) primary physical computer or POS terminal. Moving to a new machine requires license deactivation or administrative reset.
Multi-Branch / Enterprise License: Permits installation across the contracted number of terminals/branches specified in the order confirmation.
Source Code / Custom ERP License: For bespoke projects, ownership of custom application source code is transferred upon final milestone payment, excluding proprietary third-party libraries and core proprietary ByDukaan framework modules.

3. Prohibited Uses & Anti-Piracy Protection

You agree that you will NOT under any circumstances:

Decompile, disassemble, reverse engineer, or attempt to derive the source code of encrypted binaries or protected scripts.
Redistribute, sublicense, rent, lease, resell, or publicly share license keys or installation packages on warez forums, torrents, or file-sharing channels.
Bypass or disable our cryptographic licensing and hardware-binding verification modules.
Use the software to conduct illegal business operations or violate Pakistani tax or financial reporting regulations.

Violation of these licensing conditions will result in immediate and automated revocation of all active licenses without refund, and may incur legal prosecution under the Copyright Ordinance of Pakistan.

4. Software Updates & Technical Support

Free Updates: Standard software purchases include free access to minor bug-fix and compliance releases for a period of twelve (12) months from purchase date.
Remote Support: Free installation assistance via AnyDesk/TeamViewer is provided for 30 days after initial purchase. Subsequent ongoing support contracts or SLA tiers can be purchased separately.
Data Backups: The customer is solely responsible for creating regular offline and cloud database backups. While ByDukaan provides built-in automated backup utilities, ByDukaan bears no responsibility for data loss resulting from hardware failure, virus infection, or power outages.

5. Payments & Pricing

All prices are displayed in Pakistani Rupees (PKR) unless explicitly specified otherwise. Payment must be cleared in full via our secure checkout (JazzCash, EasyPaisa, Bank Cards, OneQR) before digital license keys and download links are issued.

6. Disclaimer of Warranties & Limitation of Liability

Software is provided "as is" without warranty of any kind, either express or implied. In no event shall ByDukaan, its directors, or its developers be liable for any indirect, incidental, or consequential damages (including loss of profits, business interruption, or tax penalties) arising out of the use or inability to use the software. In all events, ByDukaan’s aggregate liability is strictly capped at the total amount paid by the customer for that specific software license.

7. Governing Law & Dispute Resolution

These terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any legal disputes arising in connection with these terms shall fall under the exclusive jurisdiction of the competent courts in Lahore, Pakistan.
